EXPORTCOMPLIANCEDAILY.COM: DON’T COPY BIS AFFILIATES RULE, THINK TANKS TELL EU

In Export Compliance Daily, EPICENTER’s response to the European Commission’s evaluation of the EU’s dual-use export control rules was reported as urging the EU not to introduce its own version of the US Bureau of Industry and Security’s (BIS) Affiliates Rule, which would pose too great a compliance challenge for European firms. EPICENTER called on the Commission to “avoid copying the wrong model”, noting that BIS had released the rule without quantifying how many entities it would newly capture. It argued that this kind of extraterritorial reach places an investigative burden on firms that they cannot discharge, and that the EU should compete on predictability rather than on reach.
