The right to housing: a threat to property rights?

In this IBL Occasional Paper, the author – a Justice of Italy’s Constitutional Court – discusses the legal and economic implications of different interpretations of a constitutional “right to housing.” The paper reviews the Italian and European jurisprudence, concluding that the “right to housing” could constitute a threat to property rights if interpreted broadly by the courts.
